Terms and Conditions for Use of NasoPools.com

Before booking, please take note of these essential policies:

  • 7-Day Cancellation Policy: Any cancellations, rescheduling, or changes made within 7 business days of your appointment will result in a 100% service fee.

  • Booking Accuracy: Please ensure your pool size and cover type are selected correctly. Incorrect bookings will be adjusted to the correct price plus a $45 processing fee.

  • Refund Fees: All qualifying refunds are subject to a 6% fee to cover non-refundable merchant/credit card processing costs.

  • Swim Safety: Do NOT enter the pool for at least 7 days after an opening. The water chemistry is unsafe for swimming during this period.

  • Weather: In the event of inclement weather, we will prioritize rescheduling your service for the following business day.

  • Late Payments: In accordance with the NJ Prompt Payment Act, all overdue balances—including those from booking corrections or authorized additional on-site work—will accrue interest at the rate of 1.33% per month (16% APR).
  • Security Interest and Right of Access-  Naso Pools retains the right of ownership in all equipment until your balance is paid in full,  Not a Fixture: even once installed the equipment is considered removable personal property and doesn’t become a part of your real estate until paid in full. Right to Repossess: if you fail to pay, we have the right to enter the exterior of your property to peacefully remove our equipment. No Liability for Removal: We are not responsible for incidental damage (like disconnected plumbing or wiring) caused by removing equipment due to non-payment.  Legal Fees: You agree to cover all costs, including legal fees and collection costs, if we have to recover equipment or seek payment/

1. Data Privacy

Your personal data will be used to enhance your experience throughout this website, manage account access, and for purposes detailed in our Privacy Policy.

2. Booking Accuracy and Adjustments

  • Order Accuracy: Customers are responsible for selecting the correct pool size, cover type, and features during booking.

  • Correction Fees: Orders containing inaccurate information will be adjusted post-visit to reflect actual property conditions and current website pricing. A $45.00 administrative processing fee will apply to all such adjustments.

  • Chemicals & Water Condition: Additional charges for chemicals and return visits may apply based on water conditions. Return visits are billed at $50.00 per instance, plus the cost of required chemicals.

3. Additional Work Authorizations

To ensure efficiency, this agreement serves as a traditional written estimates under the following conditions:

  • Minor Adjustments: Work will be billed according to the transparent pricing available on our website.

  • Extensive Work: For additional services exceeding $500.00, we will seek on-site verbal authorization or telephonic approval before proceeding, Pricing in this scenario will adhere strictly to pricing available on the product pages on this website (https://nasopools.com).

  • Unlisted Services: If required work is not listed on our website and no prior pricing has been established, all work will cease until a formal written estimate is delivered and signed.

4. Cancellation and Rescheduling Policy

  • Standard Cancellations: Bookings may be canceled via your online account or email at least seven (7) business days prior to the scheduled date.

  • Late Changes: Any cancellations, rescheduling requests, or modifications made within seven (7) business days of the appointment will incur a 100% service fee. This fee compensates for the lost opportunity to fill the reserved calendar block.

5. Refunds and Shipping

  • Processing Fees: All qualifying refunds are subject to a 6% processing fee. This covers non-refundable merchant service charges (e.g., PayPal, Amazon, Credit Card processors) incurred during the original transaction.

  • Order Errors: If an order was placed in error, please contact our 24/7 customer service line immediately at 1 (201)-500-7665 to attempt a correction before processing.

  • Returns: Once an order has been processed for shipping or local pickup, it is governed by our standard Return Policy.

6. Outstanding Balances and Collections

We reserve the right to cross-reference new orders against existing accounts. For customers with balances 30+ days overdue or a history of chargebacks:

  • New payments will be first allocated toward the outstanding debt and associated fees.

  • Any remaining funds will be applied as a credit to the customer’s account.

  • If a refund of the remaining balance is requested, a 5% administrative fee will apply.

7. Safety and Weather Protocols

  • Post-Opening Safety: Do not enter the water for at least seven (7) days following a pool opening. Water chemistry is unsafe for swimming during this period; please schedule your opening accordingly.

  • Inclement Weather: We reserve the right to reschedule appointments due to unsafe weather conditions. We will make every effort to complete the service on the following business day.

8. Overdue Invoices and Late Fees (NJ Prompt Payment Act)

In accordance with the New Jersey Prompt Payment Act (PPA) and state interest rate guidelines, all invoices for services rendered—including those resulting from improper initial bookings or additional work authorized at the time of service—are due upon receipt.

  • Delinquent Balances: Any invoice remaining unpaid beyond thirty (30) days will be considered delinquent.

  • Interest Charges: Delinquent balances will accrue interest at a rate of 1.33% per month (16% APR).

  • Collection & Credits: We reserve the right to suspend future services or cancel new bookings for accounts with outstanding balances. Any new payments received will first be allocated toward the oldest outstanding debt and accrued interest before being applied to new services.

9. Security Interest and Right of Access

  • Security Interest: Seller retains a purchase money security interest in all equipment until the purchase price is paid in full. Equipment is intended to remain personal property and shall not be deemed a “fixture” or part of the real estate until fully paid.
  • Right of Entry: In the event of Buyer’s default, Buyer grants Seller a limited license to enter the exterior of the property to peaceably remove the equipment. Seller is not liable for incidental damage resulting from removal, including disconnected plumbing or electrical lines. Buyer agrees that any refusal to allow peaceful removal constitutes a breach of this agreement.
